Recent news headlines have led to some misunderstanding regarding changes to the National Association of REALTORS® multiple listing service (MLS) policies. NAR has repealed several MLS policy statements, including policies related to non-member access to MLSs. These changes take effect in January. See NAR’s FAQs.
These policy changes do not prohibit MLSs from requiring association membership. Rather, the changes clarify that the decision is up to each MLS.
By repealing inconsistent and outdated policies, NAR is reinforcing each MLS’s discretionary authority regarding non-member access. Each MLS should consult its legal counsel and follow its governing documents regarding any updates to their MLS’s bylaws, rules, and regulations.
